WEBSITE TERMS OF USE
Effective from 26 October 2026
1. ABOUT THESE TERMS
1.1 These Terms of Use ("Terms") govern your use of the website at https://ltx.co.nz (the "Website"). The Website is operated by Travel Media Limited, trading as The Luxury Travel Exchange ("LTX", "we", "us", "our").
1.2 The Luxury Travel Exchange is a hosted-buyer trade event for the luxury travel industry. It will be held from 25 to 27 May 2027 in Auckland (the "Event").
1.3 These Terms apply when you browse the Website. When you submit a form, you will be asked to tick a box to accept these Terms, the LTX Event Terms and Conditions, and our Privacy Statement.
1.4 These Terms cover the Website only. Applying for, and taking part in, the Event is governed by the LTX Event Terms and Conditions. A partner's participation is governed by the exhibitor contract it signs with us. If these Terms conflict with either of those, the Event Terms and Conditions or the exhibitor contract apply to their subject matter.
1.5 Our Privacy Statement explains how we handle personal information. It is available on the Website.
2. WHO MAY USE THE WEBSITE
2.1 The Event is a trade event. The Website and its forms are intended for people in the travel industry who act for business purposes. Applications are open only to people aged 18 or over.
2.2 If you submit a form on behalf of a business, you confirm that you are authorised to do so. In that case, "you" includes that business.
3. CHANGES TO THESE TERMS AND TO THE WEBSITE
3.1 We may update these Terms from time to time, for example to reflect changes in the law or in how the Website works. We will publish the updated Terms on the Website with a new effective date.
3.2 If you have submitted a form, we will email you about any change that materially affects you. We will do this at least 14 days before the change takes effect.
3.3 A change to these Terms does not alter any terms you have already accepted for an application, a visitor pass, or an exhibitor contract.
3.4 We may add to, change or remove any part of the Website at any time.
4. USING THE WEBSITE
4.1 You may use the Website to learn about the Event and to apply, register, or express interest in taking part. These uses may be for your business purposes.
4.2 Event details on the Website, such as the programme, speakers, partners and timings, are given in good faith. They may change as planning progresses. The arrangements that apply to you are those we confirm to you in writing.
4.3 Submitting a form does not mean you have been accepted to take part in the Event.
5. WHAT YOU MUST NOT DO
5.1 You must not:
(a) use the Website in breach of any law, including the Harmful Digital Communications Act 2015 and the computer crime provisions of the Crimes Act 1961;
(b) give false or misleading information in any form, impersonate any person, or misrepresent your business or role;
(c) try to gain unauthorised access to the Website or to any system or network connected to it;
(d) interfere with the Website or disrupt it, including by introducing malicious code or launching denial-of-service attacks;
(e) probe, scan, or test the vulnerability of the Website without our written permission;
(f) reverse engineer or copy the Website's software or design;
(g) collect personal information about other people from the Website;
(h) use the Website to send spam or other unsolicited messages.
6. INTELLECTUAL PROPERTY
6.1 We own the content of the Website, or we use it under licence. This includes its text, images, video, design, graphics, logos and software. Partner names and logos belong to the partners concerned. Some images may be used under a third party's licence terms, and those terms also apply to them.
6.2 You must not use our trade marks without our written permission.
6.3 You may view the Website. You may also print or download pages for your own use in deciding whether to take part in the Event. You must not otherwise copy, republish, sell, frame, or adapt Website content without our written permission.
6.4 You must not use Website content to train, fine-tune, or evaluate any artificial intelligence or machine learning system. You must not scrape or harvest Website content by automated means. Search engines may index the Website in line with our robots.txt file.
7. INFORMATION YOU SUBMIT
7.1 The information you give us in a form is used only as described in our Privacy Statement and in the Event Terms and Conditions. Submitting a form does not give us any licence to publish your information. We will not publish your information without your agreement.
7.2 The information you submit must be accurate and complete. If anything changes before the Event, you must tell us.
7.3 You may give us personal information about another person, such as a colleague you nominate. If you do, you confirm that you are authorised to give it to us. You also confirm that you have told that person that you are sharing their information with LTX, and where they can read our Privacy Statement.
7.4 If you send us feedback or suggestions about the Website or the Event, we may use them to improve the Website or the Event. We do not have to pay you for them.
8. ELECTRONIC COMMUNICATIONS
8.1 You agree that we may send you notices and other communications about your application or the Event by email. Those communications meet any legal requirement for them to be in writing, under Part 4 of the Contract and Commercial Law Act 2017.
8.2 We will send you marketing messages only if you have ticked the separate marketing box on a form. Every marketing message will include a free and working way to unsubscribe.
9. LINKS TO OTHER WEBSITES
9.1 The Website may link to websites run by other people, such as partners, the venue, or travel providers. We do not control those websites and we are not responsible for their content. A link does not mean we endorse the website it points to.
10. BUSINESS USE AND CONSUMER LAW
10.1 You use the Website for business purposes. You and we are both in trade.
10.2 You and we agree on the following, to the extent permitted by law and to the extent it is fair and reasonable:
(a) the Consumer Guarantees Act 1993 does not apply to the Website or to anything supplied through it, as permitted by section 43 of that Act; and
(b) sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, as permitted by section 5D of that Act.
10.3 You agree that it is fair and reasonable for you to be bound by clause 10.2, because you use the Website for business purposes and do not pay to use it.
10.4 Nothing in these Terms limits liability for fraud or for anything else that cannot lawfully be limited.
11. LIABILITY
11.1 We take reasonable care with the Website and with the security of information sent through it. However, we do not promise that the Website will always be available, or that it will be free of errors or harmful code. No system connected to the internet is completely secure.
11.2 We are not liable for any indirect or consequential loss arising from your use of the Website. This includes loss of profit, loss of business opportunity, and loss of data.
11.3 Our total liability arising from your use of the Website is limited to NZ$100.
11.4 Clauses 11.2 and 11.3 do not apply to loss caused by our fraud or wilful misconduct, or to any liability that cannot be excluded by law, including under the Privacy Act 2020.
12. YOUR RESPONSIBILITY FOR YOUR BREACH
12.1 You are responsible for, and will make good, any loss, cost (including reasonable legal costs), or claim against us that arises from:
(a) your breach of these Terms;
(b) false information you submit; or
(c) your unlawful use of the Website.
Your responsibility is reduced to the extent that we caused or contributed to the loss.
13. SUSPENDING ACCESS
13.1 We may suspend or block your access to the Website, or decline to process a form you submit, in any of these situations:
(a) we reasonably believe you have breached these Terms;
(b) it is necessary for maintenance, security or technical reasons; or
(c) we are required to do so by law.
13.2 When it is reasonable to do so, we will tell you why.
14. GENERAL
14.1 Governing law. These Terms are governed by New Zealand law. The New Zealand courts have exclusive jurisdiction over any dispute about these Terms.
14.2 Severability. If any part of these Terms is unenforceable, it is removed. The rest of these Terms continues to apply.
14.3 Waiver. If we do not enforce a right straight away, we have not given up that right.
14.4 Benefit for our people. Clauses 11 and 12 benefit our officers, employees and contractors as well as us. Each of them may enforce those clauses under subpart 1 of Part 2 of the Contract and Commercial Law Act 2017.
14.5 Transfer. You may not transfer your rights under these Terms. We may transfer these Terms to any person who takes over running the Event. If we do, we will give notice of the transfer on the Website.
